What is a Contract & the Role of a Contract Attorney?

A contract is a legally binding agreement between two or more parties. In California, a contract can be created if the following four (4) elements exist: (1) capacity of parties to the contract, (2) their consent, (3) a lawful object, and (4) sufficient cause or consideration. (See Civil Code Section 1550). Business contracts can be written, oral, or implied by conduct—though written agreements are recommended for clarity and enforcement purposes.
